This petition has been preferred by the petitioner against the order dated 01.05.2025 passed by Sub-Divisional Officer (Revenue), Patharia, District Mungeli (C.G.) in Revenue Case No. 202309250500079 A-27/2022-23 whereby appeal filed by respondent No. 4 – Muniram has been allowed. 2 3. Learned counsel for the petitioner submits that Sub Divisional Officer (Revenue), Patharia, District Mungeli has passed impugned order of remittance of the case on the ground that necessary procedures have not been followed by Naib Tahsildar, Sargaon whereas all the proceedings have been followed by Naib Tahsildar prior to passing order dated 31.07.2023. Hence, he prayed that this petition may be admitted for hearing. 4. In reply, learned counsel for the State submits that order impugned dated 01.05.2025 passed by SDO (R), Patharia, District Mungeli (C.G.) is appealable before Commissioner under Section 44 (2)(a) of the CG Land Revenue Code, 1959 (for brevity, ‘Code, 1959”) , therefore, this petition is not maintainable. 5. Heard learned counsel for the parties and perused the material available on record. 6. Having considered the issue involved in the instant petition and further considering the fact that impugned order has been passed by SDO (R.), Patharia, District Mungeli, which is appealable under Section 44(2)(a) of the Code, 1959, therefore, this Court is not inclined to entertain instant petition invoking extraordinary jurisdiction of this Court. 7. Accordingly, the instant petition stands disposed of leaving liberty in favour of the petitioner to challenge the impugned order under the aforesaid provisions of Code, 1959, 8.
