JUSTICE RAJESH RAI K ORAL ORDER Learned counsel for the respective parties jointly submitted that the dispute between the parties has been amicably settled. In this regard, the parties have filed a joint affidavit before this Court. On perusal of the said joint affidavit, particularly paragraph 12(d), it is evident that the parties have agreed to cooperate with each other for quashing and closure of the proceedings pending against the petitioner. - 3 - HC-KAR CNR: KAHC010486302024 NC: 2026:KHC:50136 CRL.P No. 9471 of 2024 2. The parties to the proceedings are present before the Court and they have affixed their signatures on the joint affidavit. The joint affidavit is taken on record. 3. Though the offences alleged in the charge-sheet are non- compoundable in nature, considering the nature of the dispute, which is purely private and matrimonial in nature, and having regard to the settlement arrived at between the parties, this Court, in exercise of its inherent jurisdiction and placing reliance on the judgment of the Hon'ble Apex Court in Gian Singh v. State of Punjab, reported in (2012) 10 SCC 303, is of the considered opinion that continuation of the proceedings would not serve any useful purpose. Accordingly, the parties are permitted to compound the dispute and the proceedings against the petitioner are liable to be quashed. 4. Consequently, the proceedings against the petitioner- accused arising out of Crime No.179/2024 dated 02.05.2024, registered by Sarjapura Police Station, Anekal Sub-Division, for the offences punishable under Sections 380 and 420 of the IPC, pending on the file of the Principal Civil Judge (Jr.Dn.) and - 4 - HC-KAR CNR: KAHC010486302024 NC: 2026:KHC:50136 CRL.P No. 9471 of 2024 JMFC Court, Bengaluru Rural District, Bengaluru, are hereby quashed. In view of the joint affidavit filed by the parties and the undertaking contained in paragraph 12(d) thereof, the petition stands disposed of accordingly.
