In this application, the petitioner has prayed for expeditious disposal of the proceeding being G.R. Case No.1332 of 2020 presently pending before learned Judicial Magistrate, 5th Court, Serampore. Being aggrieved by the inordinate delay caused in disposal of the instant proceeding, learned Counsel for the petitioner submits that de facto complainant/wife lodged the written complaint on 1st October, 2020. After completion of investigation, police submitted charge-sheet on 22.03.2021. After 3 years of filing charge-sheet, the charges were framed against all the accused persons on 12.08.2024 and next date was fixed on 19.12.2025 for recording evidence of the prosecution. Since then the trial has got stalled and, therefore, the petitioner being the accused is suffering a lot and, therefore, he prays for appropriate direction upon the Court below for expeditious disposal of the said proceeding. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will
2 have no cause to prejudice and as such service of copy of application upon the opposite party is dispensed with. Having considered submissions made on behalf of the petitioner and that the trial of the proceeding has got stalled for more than a year, I find that the prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice. In view of above, CRR 4668 of 2025 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the said proceeding and to make his best endeavour to conclude the entire proceeding preferably within a period of six months from the next date of hearing. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
