The learned advocate appearing for the petitioner submits that more than Rs.3,74,000/- has already been deposited by the petitioner before the appellate authority. She submits that in view thereof, the order directing freezing of the bank account of the petitioner trust should be vacated. After going through the order dated 20th August, 2026, this Court finds that the Certificate Officer has requested the Controlling Authority to confirm whether any amount has been deposited by the certificate debtor in connection with any appeal arising out of or relating to the order on the basis of which the present certificate was issued and forwarded to the Certificate Officer for execution. The Controlling Authority was further requested to communicate the present status of such appeal, if any, and the details of the amount deposited on or before the next date of hearing. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite parties. It will be open to the petitioner to approach the Certificate Officer along with all materials in support of the claim that the entire amount has been deposited before the Appellate Authority as well as the stage of the appeal before
2 the Appellate Authority and the orders passed by the Appellate Authority. If such an approach is made, the Certificate Officer, South 24 Parganas shall take up the hearing by preponing the next date considering the urgency involved in this matter as the petitioner has prayed for vacating the order of freezing the bank accounts. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
