JUSTICE S VISHWAJITH SHETTY ORAL ORDER Learned counsel for the petitioner after arguing the matter for sometime submits that, at this stage, this petition may be dismissed as not pressed with a direction to the Trial Court to examine CW-2-victim girl within a time frame, and reserve liberty to the petitioner to renew his bail application before the Trial Court after CW-2 is examined. - 3 - HC-KAR CNR: KAHC010515922026 NC: 2026:KHC:49289 CRL.P No. 11277 of 2026 2. Learned High Court Government Pleader and learned counsel for respondent No.2 do not oppose the prayer made by the learned counsel for the petitioner. 3. Learned counsel for respondent No.2 submits that the victim girl shall cooperate before the trial Court. 4. The aforesaid submissions are placed on record. 5. The petition is disposed of with a request to the Trial Court to expedite the Trial in Special Case No.1243/2026 and examine CW-2-victim girl at the earliest, but not later than a period of five months from the date of receipt of copy of this order. Immediately after the examination of CW-2 or after expiry of the aforesaid period of five months whichever is earlier, the petitioner is at liberty to file a fresh bail application.
