1. Matter is heard in presence of learned advocates representing petitioners and State respondents.
2. It is submitted on behalf of petitioners that based on complaint lodged concerned police authorities are required to take steps in accordance with law and to preserve CCTV footage of alleged incident.
3. Learned advocate representing State respondents has filed a communication dated 27th August, 2026 of Additional Officer-in-Charge, Beliaghata Police Station and same is taken on record. Copy of the said communication dated 27th August, 2026 is made over to the learned advocate representing petitioners.
4. It is disclosed in the said communication that based on complaint lodged Beliaghata P.S. Case no.194/ 2026 dated 8th August, 2026 has been initiated on registering FIR. It is also disclosed in the communication that during investigation CCTV cameras installed at nearby places were scrutinized in order to preserve footage of alleged incident but nothing relevant was found.
5. Having considered the case made out in the writ petition and taking note of contents of communication
[2] dated 27th August, 2026, it appears that by registering FIR aforesaid criminal prosecution has been initiated. If petitioners are aggrieved relating to enquiry being conducted, petitioners shall be at liberty to approach jurisdictional Magistrate under Section 175(3) of BNSS, 2023.
6. Hence, writ petition stands disposed of.
