1. Learned counsel for the petitioners submits that an old tamarind tree adjacent to the residential house of Petitioner No. 1 fell due to a severe thunderstorm.
To protect his house from collapsing and prevent injury or loss of life to his family and neighbours, Petitioner No. 1 cut and removed the fallen tree. Thereafter, private Respondents No. 7 to 14 unlawfully called an unauthorized village meeting and imposed a monetary fine of 30,000/-, later ₹ revised to 21,000/-, upon Petitioner No. 1. Upon his inability to ₹ pay the fine, they declared a total social boycott (Hookah-Pani Band) against Petitioner No. 1 and his family members, prohibiting villagers from interacting or trading with them or offering them services. Further, Respondent No. 6, in collusion with the private respondents, unlawfully intercepted and confiscated the ration card application form submitted by Petitioner No. 2 at Janpad Panchayat Chhuriya and declared that no government or social benefit would be allowed until the fine was paid. Despite multiple written complaints to the concerned authorities, Respondents No. 1 to 5 failed to take appropriate action to protect the fundamental rights of the petitioners or restrain the perpetrators of the social boycott. The petitioners have therefore, sought the following reliefs:-
“ 10.1 Issue a Writ of Certiorari / Mandamus or any other appropriate writ or order setting aside and quashing the illegal decision/resolution passed by Respondents No. 6 to 14 imposing a
4 fine of 21,000/- and declaring social boycott ₹ (Hookah-Pani Band) against the Petitioners and their families. 10.2 Issue a Writ of Mandamus directing Respondents No. 1 to 5 (State Authorities) to take strict legal and preventive action against Respondents No. 6 to 14 under the relevant law and ensure that no person or authority in the village prevents the Petitioners from exercising their civil rights, receiving government benefits (such as ration cards), or participating in social life.
10.3 Direct the State Authorities to extend full protection to the Petitioners and ensure uninterrupted access to statutory benefits, ration cards, essential public utilities, and normal social living without interference; 10.4 Pass such other or further writ, order or direction as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case, including award of costs in favour of the Petitioners. 2. Learned counsel appearing for the State submits that the petitioners have not lodged any F.I.R. against the private respondents and therefore, the relief sought by them cannot be granted at this stage. The petitioners may approach the concerned police station and if a cognizable offence is found to have been committed, an F.I.R. shall certainly be registered against them. 5
3. On the basis of the aforesaid submission made by learned counsel for the State, the petitioners are directed to approach Police Station Chhuriya, Tahsil Chhuriya, District Rajnandgaon (C.G.) and lodge an FIR against the private respondents. The concerned SHO of Police Station Chhuriya is directed to lodge an FIR forthwith if a cognizable offence is found to be disclosed in the complaints made by the petitioners against the private respondents. 4. With the aforesaid observations and directions, this writ petition stands disposed of. SD/-
