Dr. Achin Jana, learned Advocate for the State is also present. 3. This appeal was filed at the instance of the appellant challenging the impugned judgment and order of conviction dated 05.04.2017 and 06.04.2017 passed by the learned Trial Court in connection with Sessions Trial No. 54 of 2010, in which this appellant was found guilty for commission of offence punishable under Sections 307/326 of the Indian Penal Code and he was sentenced accordingly. 4. The direction was given by this Court on 27.08.2026 upon the Superintendent, Hooghly Correctional Home as to whether the appellant/convict has been released after remission of the unexpired portion of the sentence pursuant to Order No. 635-S 2 dated 27.07.2012. The order passed by this Court has been duly communicated to the Superintendent, Hooghly Correctional Home. 5. In pursuance of the said direction, a report is submitted by the Superintendent, Hooghly District Correctional Home on 10.09.2026 indicating that the Hon’ble Governor was pleased to release the appellant after remission of the unexpired portion of the sentence as imposed by the learned Trial Court. 6. In pursuance of the Judicial Department, Government of West Bengal, vide memo no. 581-JL/JD/L/16M-31/22, dated 08th August, 2022, the appellant/convict, Samir Mondal, has been released from the custody of the Hooghly District Correctional Home on 15.08.2022. 7. In view of such release of the appellant/convict from the concerned Correctional Home, this appeal becomes infructuous. 8. Accordingly, the instant appeal be and the same is hereby dismissed. 9. The impugned judgment and order of conviction passed by the learned Trial Court dated 05.04.2017 and 06.04.2017 in connection with Sessions Trial No. 54 of 2010 is hereby affirmed. 10. The report, submitted by the Superintendent, Hooghly District Correctional Home, be taken on record. 11. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately. 3 12. Urgent photostat certified copy of the order, if applied for, be given to the parties upon complying with all legal formalities. (Prasenjit Biswas, J.)
