Hon’ble Shri Justice Naresh Kumar Chandravanshi, J Order on Board (13th October, 2026) This is the first bail application under Section 483 of BNSS, 2023 by the applicant for grant of regular bail as he surrendered on 4.8.2026 before the concerned trial court in connection with Crime No.68/2022 2 registered at Police Station – Saraswati Nagar, Raipur for the offence punishable under Sections 420, 467, 468 and 471 of IPC. 02. Allegation against the applicant, in brief, is that he obtained employment on the post of Line Attendant, Grade-II in CSPTCL, on the basis of forged certificate of ITI. Hence an FIR was lodged by CSPTCL against the applicant, based on which after investigation charge sheet for the offence under Sections 420, 467, 468 & 471 of IPC was filed against him showing him absconder. When the process of proclamation was issued, then the applicant surrendered himself before the concerned trial Court on 4.8.2026 and a Criminal Case No.17697/2024 was registered and fixed for hearing. 03. Learned counsel for the applicant submits that allegation against the applicant is that he secured employment on the basis of forged and fabricated certificate of ITI issued by the State Board of Examination, State Vocational Training Council, Jabalpur, Madhya Pradesh but no verification has been sought from the aforesaid Board, rather the applicant has been implicated in the instant case only on the basis of enquiry report submitted by the department of the applicant. The applicant is in jail since 4.8.2026 and he has no criminal antecedents. Hence he prays that the applicant may be enlarged on bail. 04. Per contra, learned counsel appearing for the State opposes the bail application. 3 05. Heard learned counsel for the parties and perused the case diary. 06. Having considered the facts and circumstances of the case, the fact that the applicant is in jail since 4.8.2026; he has no criminal antecedents; charge sheet has already been filed, as such, there is no requirement of any custodial interrogation of the applicant; and that conclusion of the trial is likely to take some time, without expressing any opinion on merits of the case, this Court is inclined to allow the instant bail application. Accordingly, the bail application of the applicant is allowed. 07. Let the Applicant – Janik Ram Karsh, involved in Crime No.68/2022, registered at Police Station-Saraswati Nagar, Raipur (C.G.) for the offence punishable under Sections 420, 467, 468 and 471 of IPC be released on bail on his furnishing a personal bond for a sum of Rs.25,000/- with two sureties in the like sum to the satisfaction of the Court concerned with the following conditions:- (a) the applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) the applicant shall not act in any manner which will be prejudicial to fair and expeditious trial, (c) the applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. 4 (d) the applicant and his sureties shall submit a copy of their Aadhar Card along with a coloured postcard full size photo having printed the Aadhar number on it, which shall be verified by the trial Court. (e) the applicant shall not involve himself in any offence of similar nature in future.
