Heard Mr. Sheo Kumar Singh, learned counsel for the appellant and learned Spl. P.P. for the State. 2. This appeal is directed against the order dated 09.12.2025 passed in Misc. Cr. Application No. 2760 of 2025, by the learned Additional Sessions Judge-VIII, Palamau at Daltonganj, in S.T. No. 127 of 2021 arising out of Pandu P.S. Case No. 37 of 2016, corresponding to G.R. Case No. 1712 of 2016 whereby and whereunder the prayer for bail of the appellant has been rejected. 3. It has been alleged that in course of patrolling near Merciya Jungle some persons were found fleeing away who were apprehended and who disclosed their names as Krishna Yadav and Birja Lal Sharma. 4. Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated on confessional statement of co-accused namely Guddu Yadav @ Nirbhay Jee. It has further been submitted that the appellant is in custody since 07.11.2025 and no incriminating articles were recovered from the possession of the appellant and one of the co-accused similarly situated namely Ravindra
2026:JHHC:5483-DB 2 Cr. A. (DB) No.244 of 2026 Mehta has been granted bail in Cr. Appeal (DB) No. 480 of 2024. 5. Learned Spl. P.P. has opposed the prayer for bail of the appellant. 6. Regard being had to the manner of implication of the appellant and the fact that one of the co-accused similarly situated has been granted bail by a co-ordinate Bench of this Court, we while setting aside the order dated 09.12.2025 passed in Misc. Cr. Application No. 2760 of 2025, by the learned Additional Sessions Judge-VIII, Palamau at Daltonganj, in S.T. No. 127 of 2021arising out of Pandu P.S. Case No. 37 of 2016, corresponding to G.R. Case No. 1712 of 2016, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-VIII, Palamau at Daltonganj, in S.T. No. 127 of 2021 arising out of Pandu P.S. Case No. 37 of 2016, corresponding to G.R. Case No. 1712 of 2016, subject to the condition that the appellant shall remain physically present before the learned trial court on each and every date till the conclusion of the trial until prevented by sufficient cause. 7. Accordingly, this appeal is allowed.
