Mrs. Maheswari Sharma Mrs. Tulika Banerjee …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Additional Civil Judge (Senior Division), 1st Court at Barasat to dispose of the application under Sections 5 and 8 of the Arbitration and Conciliation Act, 1996 filed by the opposite parties, expeditiously. The learned advocate appearing for the petitioner submits that the said application was taken up for hearing on several occasions but is yet to be disposed of. She submits that the next date for hearing of such application has been fixed on 20th February, 2027 (wrongly recorded in the order as 20th February, 2026). In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioner, this civil revisional application stands disposed of by requesting the learned Civil Judge (Senior Division), 1st Court at Barasat to dispose of the application under Section 5 and 8 of the Arbitration of the 2 Conciliation Act, 1996 as expeditiously as possible but preferably within a period of six weeks from the next date fixed without grating any unnecessary adjournment to either of the parties.
