The learned senior advocate for the respondents/writ petitioners, Mr. Chatterjee, appears along with instructions as per the direction dated 20.08.2026 and submits that in view of the decision of the Hon’ble Supreme Court of India in the case of R.S. Madireddy and Another Versus Union of India and Others reported in 2024 SCC OnLine SC 965, that he will avail remedy before the Industrial Tribunal.

3. We, accordingly, dispose of the instant appeal as well as the writ petition by granting such liberty to the writ petitioners/respondents to avail remedy, if otherwise is entitled to in accordance with law.
