Learned Advocate appearing for the petitioners submits that petitioners were well acquainted with the principal accused Jamir Abbas @ Anupam Roy who has used them for accepting transactions in their accounts for his misdeeds. 2. Learned Advocate for the State opposes the prayer for anticipatory bail and submits that custodial detention of the present petitioners are warranted. 3. I have taken into account the overall nature of accusations wherein the complainant alleges of a sum of Rs. 8,23,000/- having been taken and/or deposited pursuant to 2 the representations made by Jamir Abbas @ Anupam Roy. Some of the amounts were deposited in the account of the present petitioners. 4. Movement of the money prima facie reflects that substantial amount was taken away by the said Jamir Abbas @ Anupam Roy. Although some money remained in the account of these two accused persons. 5. I have considered the statement of account and I find that the nature of transactions except those deposited by the complainant are very minimal. Prima facie I am of the opinion that although the petitioners may have aided the principal accused in connection with the alleged offence but the culpability with which the principal accused has committed the offence is not available till date from the materials collected by the Investigating Agency so far as these two petitioners are concerned. 6. Having regard to the same I am of the opinion that the petitioners custodial interrogation at this stage may not be called for. As such prayer for anticipatory bail of the petitioners is allowed. 7. As such, I direct that in the event of arrest, the petitioners, namely, 1. Somnath Porel 2. Debasish Manna be released on bail by the Investigating Officer/arresting officer of the case on such terms and conditions as it deems fit and proper. This would be subject to the conditions under Section 438(2) of the Cr.P.C and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 3 8. As the investigation of the case is in progress, petitioners shall make themselves available before the Investigating Officer within a period of ten days from the date of the order and shall subsequently follow the Investigating Officer as and when called for till the report in final form is submitted before the jurisdictional Court. 9. Accordingly, CRM (A) 2954 of 2026 is allowed. 10. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court. 11. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
