In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Sonarpur Police Station case no. 133 of 2016 dated 25.01.2016 under Sections 302 of the Indian Penal Code.

Learned advocate appearing for the petitioner submits that petitioner was arrested on January, 2016 and till date he is in custody for more than 10 years 2 months. The prosecution witnesses are yet to be completed, as such petitioner prays for bail. Learned advocate for the State submits that so far as examination-in-chief of the investigating officer who is the last witness has been completed and the cross-examination is being deferred on repeated occasions and the next date is fixed on 18th of April, 2026. Having considered the advance stage of the case, I am not inclined to release the petitioner on bail. However, this will not create any impediment if there is any statutory right vested to the petitioner. With the aforesaid observation CRM (M) 660 of 2026 is dismissed.
2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
