In this application, the petitioner has prayed for expeditious disposal of C. Case No.845 of 2015 presently pending before learned Chief Judicial Magistrate, 1st Court, Barasat. Being aggrieved by the inordinate delay caused in disposal of the instant proceeding, learned Counsel for the petitioner submits that petitioner filed the above-mentioned complaint case under Section 138 of the N.I.Act on 16.06.2014. Thereafter learned Magistrate dismissed the complaint and thereby discharged the accused persons on 17.08.2017. The petitioner preferred an appeal and by an order dated 28th November, 2019, this High Court directed the Magistrate to restore the complaint case and to dispose it of at the earliest. Since then the matter is pending without any further development. Therefore, he has prayed for necessary direction upon the Court below. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice and as such service of copy of application upon the opposite party is dispensed with.
2 Having considered the fact that the said complaint case is pending since June, 2014 and that the statute provides for a time limit in disposal of such case, I find that the prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice. In view of above, CRR 2179 of 2025 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the proceeding being C. Case No.845 of 2015 and to make his best endeavour to conclude the entire proceeding preferably within a period of six months from the next date of hearing. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
