ORAL ORDER
Heard the learned counsel appearing for the petitioner and the learned High Court Government Pleader for the respondent No.1.
2. This petition is filed to quash the proceedings in C.C. No.4680/2025 pending before the VIII Additional Chief Metropolitan Magistrate, Bengaluru.
3. The offences alleged are under Sections 323, 324, 354, 504 read with Section 34 of the Indian Penal Code, 1860 ('IPC').

Learned counsel for the petitioner would submit that there is a delay of 7 days in filing the complaint and there Digitally Signed by ANANT RAMNATH HEGDE

is no allegation of assault with iron rod against the petitioner. Said allegation is only against accused no.1.
5. It is the further submission that accused/petitioner had no intention to commit any offence. Merely because he happened to be the neighbour of the complainant, a false case is filed and the charge sheet is registered and the cognizance is taken.
6. Learned High Court Government Pleader would submit that the contentions raised are based on disputed facts. There is an allegation that the petitioner along with others also assaulted the complainant, merely because there is no allegation that the complainant was not assaulted with a rod, there cannot be a ground to quash the proceedings.
7. The Court has considered the contentions raised at the Bar and perused the records.
8. In the complaint it is stated that the petitioner along with the other accused assaulted and abused the complainant and family members. Of course, it is true that there is no allegation of assault by the complainant with an iron Digitally Signed by ANANT RAMNATH HEGDE

rod. However, there is an allegation of assault, if not by iron rod and also there is an allegation of abuse.
9. In fact, allegation of threat is also found in the charge sheet.
10. Under these circumstances, the contention of the petitioner that he had no such intention cannot be considered at this stage and hence, the petition is dismissed.
11. If the petitioner is of the view that there are no materials to frame the some of the charges mentioned in the charge sheet, it is open to the petitioner to raise such
contentions as advised in law.
