Vs The State of West Bengal In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ under Section 438 of the Code of Criminal Procedure, 1973 arising out of Uluberia Police Station Case No. 133 of 2022 dated 07.05.2022 under Sections 147/148/149/186/427 of the Indian Penal Code and Sections 3 and 4 of the Explosive Substances Act, 1908 corresponding to G.R. No. 1035 of 2022. And In the matter of : 1. Sk. Israfil @ Bhodul @ Bhodor 2. Julhas Sha @ Juluyas Sha ……Petitioners. Mr. B. Bhattacharyya Mr. Shahid Uddin Ahmed Mr. Anupam Bar Mr. P. Roy …for the Petitioners Ms. Shalini Bairagi …for the State 1. Learned Advocate appearing for the petitioner submits that the complaint referred to 100 to 150 persons and charge-sheet was submitted against 14 persons. Petitioners were impleaded as accused and after almost four years they are being chased by the police authorities. Petitioners were not aware regarding the criminal case pending against them. 2. Learned Advocate for the State opposes the prayer for anticipatory bail. 2 3. A report has been submitted by the Inspector-in-Charge, Uluberia Police Station which reflects that there are no previous antecedents. 4. Having considered the same the prayer for anticipatory bail is allowed. 5. As such, I direct that in the event of arrest, the petitioners, namely, 1. Sk. Israfil @ Bhodul @ Bhodor 2. Julhas Sha @ Juluyas Sha be released on bail by the Investigating Officer/arresting officer of the case on such terms and conditions as it deems fit and proper. This would be subject to the conditions under Section 438(2) of the Cr.P.C and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 6. As charge-sheet has already been submitted, this order of anticipatory bail will remain in force for a period of six weeks. 7. Accordingly, CRM (A) 1837 of 2026 is allowed. 8. Memo of evidence submitted be kept with the record. 9. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court. 10. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
