JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.5 in SC No.5024/2026 pending before the Court of IV Additional District and Sessions Judge, Tumakuru sitting at Madhugiri arising out of Crime No.55/2019 registered by Madhugiri Police Station, Tumakuru for the offence punishable under Section 395 of IPC, 1860, is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.55/2019 was registered by Madhugiri Police Station, Tumakuru for the aforesaid - 3 - HC-KAR CNR: KAHC010525512026 NC: 2026:KHC:50274 CRL.P No. 11487 of 2026 offences against unknown persons, based on the first information dated 22.03.2019 received from Ronald Farnandies. After completing investigation, charge sheet has been filed in which he is shown as absconding. Subsequently, he was arrested and produced before the Court on 27.03.2026 and remanded to judicial custody. His bail application filed before the trial Court in Crl.Misc.No.5219/2026 was rejected on 15.07.2026. Therefore, he is before this Court. 4. Learned counsel for the petitioner has made available to this Court a copy of the judgment and order in SC No.5010/2020 and SC No.5025/2022 in which accused Nos.1, 3 and 4 in the present case were tried and acquitted by the trial Court by judgment and order of acquittal dated 29.04.2026. Allegation as against all accused persons named in the charge sheet are similar. After accused Nos.1, 3 and 4 were acquitted by the trial Court in SC No.5010/2020 and SC No.5025/2022, accused No.2 in SC No.5024/2026 had approached this Court - 4 - HC-KAR CNR: KAHC010525512026 NC: 2026:KHC:50274 CRL.P No. 11487 of 2026 seeking regular bail in Criminal Petition No.9217/2026 and the said petition was allowed by this Court on 04.08.2026. 5. It is brought to the notice of this Court that the petitioner is a person with criminal antecedents and in addition to the present case, he has three other criminal cases pending against him. Considering the aforesaid aspect of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following: O R D E R The Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in SC No.5024/2026 pending before the Court of IV Additional District and Sessions Judge, Tumakuru sitting at Madhugiri arising out of Crime No.55/2019 registered by Madhugiri Police Station, Tumakuru for the offence punishable under - 5 - HC-KAR CNR: KAHC010525512026 NC: 2026:KHC:50274 CRL.P No. 11487 of 2026 Section 395 of IPC, 1860, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. - 6 - HC-KAR CNR: KAHC010525512026 NC: 2026:KHC:50274 CRL.P No. 11487 of 2026 f) The petitioner shall appear before the Station House Officer (S.H.O) of Madhugiri Police Station on every first of the month between 10.00 a.m. and 1.00 p.m. and mark his attendance regularly for the period of one year from the date of his release from custody.
