1. Affidavit-of-service filed in Court today be kept on record.
2. The petitioner is a physically handicapped person, whose father expired on 20.01.2025. The petitioner claims to be entitled to the family pension under the WBS (DCRB) Rules, 1971 as amended from time to time.
3. In fact, by the Memo No. 882- HED/23012/46/2024-ILC/2025 dated 08.12.2025, the petitioner claims that a physically disabled son of a deceased employee (teaching or non-teaching) of government aided colleges are entitled to the family pension even after attaining the age of 25 years, for life subject to fulfillment of certain conditions.
4. In view thereof, the respondent no. 2 is directed to consider the representation of the petitioner dated 05.04.2025 as recommended by the college authorities, in light of the aforestated memorandum dated December
2 08, 2025 in accordance with the applicable rules. Let such representation be considered upon adequate prior notice of hearing to the petitioner. Let this process be completed by March 15, 2026.
5. Upon the representation being considered and disposed of, the respondent no. 2 will intimate the petitioner of the result of such consideration by March 30, 2026.
6. With the aforestated directions, the present writ petition is disposed of.
7. There shall be no order as to costs.
8. Let urgent Photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
