This Criminal Appeal has been filed on behalf of the appellant for granting relief under Section 341 of the Code of Criminal Procedure, 1973 [2 of 1974] or 380 of BNSS against the rejection orders passed by the learned Additional Sessions Judge- III of Shri Rakesh Chandra in the Civil Court at Koderma of the Jharkhand State in a Miscellaneous Criminal Application No.677 of 2024, and a Miscellaneous Criminal Application No.389 of 2024, the Interlocutory Application in a Session Trial No.58 of 20323, filed under Section 340 of the Code of Criminal Procedure, 1973 [2 of 1974] or 380 of BNSS before the learned Court where the Session Trial No.58 of 2023 is pending. 2. It appears from the Letter No.85 of 2026 dated 11.02.2026 sent by Sri Rakesh Chandra, learned Additional Sessions Judge-III, Koderma, that the appellant namely Shailendra Prasad has been acquitted from the charges under Sections 341,323,307,325,504 & 427 of IPC. Learned counsel for the petitioner has submitted that this appeal may be heard on merit of this case and necessary order may be passed as the appellant has been harassed by the Respondent No.2. 4. However, learned counsel for the Respondent No.2 has submitted that the S.T. Case No.58 of 2023 (arising out of Chandwara P.S. Case No.89 of 2020) has been disposed of and the sole appellant has been acquitted in that case. 5. Thus, this Court is not inclined to entertain this issue as the appellant has been acquitted in connection with S.T. Case No.58 of 2023 (arising out of Chandwara P.S. Case No.89 of 2020). 6.
