In this petition, the relief is sought for quashing C.C.No.1300/2019 for the offence punishable under Sections 406, 419 and 420 of IPC read with Section 34 of IPC. 3. The material discloses that PCR was filed and consequent upon referring the matter under Section 156(3) of Cr.P.C., FIR was filed and police investigated the matter and filed the charge sheet. 4. The Trial Court also having perused the charge sheet, taken cognizance and the allegation made in the complaint as well as in the charge sheet in column No.17 is that accused No.1 while selling the property on 15.11.2017 suppressing the sale made, without including the name of complainant-C.W.1 even though, she was not divorced, executed the document of sale in favour of accused No.2 and committed the offence. When such allegations are made and the investigation is conducted by the police and C.W.2 to C.W.11 are eyewitnesses and other witnesses are also cited and when such material is placed before the Court, it is a matter of trial and question of entertaining the petition under Section 482 of Cr.P.C. does not arise. - 4 - HC-KAR CNR: KAHC010122622020 NC: 2026:KHC:51477 CRL.P No. 2588 of 2020 Accordingly, the petition is dismissed.
