1. Learned advocate for the State files a copy of the application of the petitioner seeking family pension dated 18th March, 2025, which is taken on record. 2. By the present writ petition, the petitioner seeks for direction upon the respondent authorities to disburse interest on delayed payment of arrear family pension from the date of entitlement till the date of actual payment @ 18% per annum. 3. The petitioner contends that her father late Biharilal Mapa was an Assistant Teacher of Math Chandipur Sri Ramkrishna Adarsha Prathamik Vidyalaya District-Purba Medinipur. The petitioner’s father retired from service on superannuation on 31st March, 1979 and subsequently died on 20th January, 1980 without getting any family pension. The mother of the petitioner died on 14th December, 2011. During her lifetime, the mother also did not receive any family pension. The petitioner is the unmarried daughter of the deceased employee. On 11th
2 May, 2026, Pension Payment Order was issued in favour of the petitioner. The arrear family pension was disbursed on 21st May, 2026. However, no interest has been paid to the petitioner. Hence, this writ petition. 4. Mr. Sourav Mitra, learned advocate for the petitioner submits that the petitioner is entitled to interest on delayed payment of arrear family pension from the date of the entitlement till the date of actual payment. 5. Learned advocate for the State submits that the application seeking for family pension was made by the petitioner only on 18th March, 2025. As such, there is no such delay in disbursement of the arrear family pension. 6. It is found from the copy of the application that the petitioner approached the authority for sanction of family pension only on 18th March, 2025. As such, the entitlement of interest on delayed payment of arrear family pension will be from the date of application, i.e., on 18th March, 2025. 7.
In view of the above, respondent No.2, the Director of Pension, Provident Fund and Group Insurance and respondent No.3, the Treasury Officer, Tamluk are directed to disburse interest @ 8% per annum on the arrear family pension in favour of the petitioner on and from 18th March, 2025 till the date of actual payment within a period of eight weeks from date of communication of this order. 8. Learned advocate for the petitioner is directed to communicate this order to respondent No.2, the Director of Pension, Provident Fund and Group Insurance and
3 respondent No.3, the Treasury Officer, Tamluk, for necessary compliance. 9. With the above direction, the writ petition being WPA 17160 of 2026 stands disposed of. 10. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 11. Interim order, if any, stands vacated. 12. All connected applications, if any, stand disposed of. 13. There shall be no order as to costs. 14. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 15. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities. (Bivas Pattanayak, J.)
