1. Heard Mr. B. Kaushik, learned counsel for the petitioner and Mr. P. Borthakur, learned Additional Public Prosecutor, for the State respondent. 2. This is an application under Section 482 BNSS, 2023 praying for granting transit anticipatory bail to the petitioner, Deepjyoti Kalita, who is apprehending arrest in connection with E- FIR No. 105/2026 dated 09.03.2026 registered at Cyber Police Station, South West District, New Delhi under Sections 318(4)/319/340/308 BNS. 3. With regard to the said he has received a notice under Section 94/106 BNSS from the said police station in Delhi. A copy of which has been annexed as Annexure-2. It is submitted that the petitioner is a daily wage earner aged about 23 years and he was duped by some persons to part with some money and also details of his bank account with a false assurance of offering Government scheme. But, later, he discovered their fraudulent activities. It is stated that in connection with the same, he lodged an FIR before the Rangia PS on 18/03/2026, a copy of which has been annexed as Annexure-1. 4. It is submitted that invoking the provisions laid down by the Hon’ble Supreme Court in Priya Indoria Vs. State of Karnataka and Ors. reported in (2024) 4 SCC 749, he may be given transit anticipatory bail to move the jurisdictional court. 5. I have also heard the learned Additional Public Prosecutor. 6. In terms of the law laid down by the Hon’ble Supreme Court in Priya Indoria (supra) such a power can be exercised to enable the petitioner in a suitable situation to move the jurisdictional court. 7. I have considered the contentions made by the petitioner and his complaint made before the Rangia police.
In the given facts and circumstances in exercise of powers under Section 482 BNSS and the principles laid down in Priya Indoria (supra) – it is directed that in the event of his arrest in connection with E- FIR No. 105/2026 dated 09.03.2026, he may be allowed to go on bail of Rs.30,000/- with one surety to the satisfaction of the arresting authority, subject to the condition that the petitioner: Within the stipulated period as mentioned below shall move the jurisdictional court and render cooperation to the investigation from now onwards and in the future. 8. The aforesaid Transit anticipatory bail is granted for a period of 3
