Heard both sides. 3. Learned counsel for the petitioner submits that in course of hearing the opposite party nos. 1 and 2 have expired. 4. Learned counsel for the opposite party no.3 is present. 5. On hearing the learned counsels for the parties and on considering the fact that transfer of a partition suit has been sought for, this Court is not inclined to grant the prayer for transfer. 6. Learned counsel for the petitioner submits that as his client is 78 years old, she may be permitted to appear virtually. 7. Considering the above fact, the same may be considered by the trial court in accordance with law, if such prayer is made. 2 8. Admittedly, the petitioner also has a son and as such the petitioner can always authorize someone to appear on her behalf in the partition suit as the properties are situated within the jurisdiction of the trial court and a partition suit also requires investigation and other related matters for which a prayer for transfer cannot be considered, in view of the grounds for transfer as made out. 9. The civil revision stands dismissed. 10. The trial court shall proceed with the suit expeditiously. 11. CAN 1 of 2026 stands disposed of. 12.
