1. Report filed by the State furnished by the District Inspector of Schools (PE), Nadia dated 27th August, 2026 is taken on record. 2. By the present writ petition, the petitioner seeks direction upon the respondent authorities to disburse interest on delayed payment of arrear pension from the date of death of her mother till the date of actual disbursement at the rate of 10 percent per annum. 3. The petitioner contends that her father late Khagendralal Chakraborty was an Assistant Teacher of Subhas Nagar Ramchandra Primary School under the District–Nadia. The petitioner’s father retired from service on superannuation on 31st July, 1990 and subsequently died on 21st May, 2000. The mother of the petitioner died on 19th July, 2014. The Pension Payment Order was issued on 20th September, 2022. Arrear family pension was disbursed on 5th January, 2023. However, no interest has been paid to the petitioner. Hence, this writ petition. 2

Mr. Dilip Kumar Maiti, learned advocate for the petitioner submits that there is delay in disbursement of the arrear family pension and, as such, the petitioner is entitled to interest on delayed payment of such arrears from the date following the date of death of her mother till the date of actual payment. 5. Mr. Sourav Sengupta, learned advocate for the State submits that there is no provision or orders of the Government to grant interest on arrear family pension. However, he leaves the matter to the discretion of the Court. 6. It is found from the pleadings of the writ petition that the date of application by the petitioner for getting the family pension has not been stated. 7. In view of the above, respondent No.3, the Director of Pension, Provident Fund and Group Insurance and respondent No.4, the Treasury Officer, Krishnanagar-1 are directed to disburse interest @ 8% per annum on the arrear family pension in favour of the petitioner from the date of the application till the date of actual payment within a period of eight weeks from date of communication of this order. 8.
Learned advocate for the petitioner is directed to communicate this order to respondent No.3, the Director of Pension, Provident Fund and Group Insurance and respondent No.4, the Treasury Officer, Krishnanagar-1 for necessary compliance. 9. With the above direction, the writ petition being WPA 27720 of 2025 stands disposed of. 3
10. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 11. Interim order, if any, stands vacated. 12. All connected applications, if any, stand disposed of. 13. There shall be no order as to costs. 14. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 15. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities. (Bivas Pattanayak, J.)
