The writ application has been preferred praying for a direction upon the respondent authority to reactivate the petitioner union’s name in the official website of the Registrar of Trade Unions and to allow submission of all forms and returns by the Union to be made in the office of the Registrar of Trade Unions with issuance of a fresh/duplicate certificate of registration and to act in accordance with law. Mr. Debanjan Mukherjee, learned counsel for the State is present and represents the Registrar of Trade Unions. 2 Learned counsel for the State submits that as the petitioner did not submit the requisite documents including the returns, the registration was cancelled. It is further submitted on behalf of the State that the Registrar of Trade Unions is open to the petitioner’s prayer, as prayed for in the writ application but subject to the condition that all the formalities as required under the law is complied with by the petitioner for such registration and its re-activation. It appears from the record that that the petitioners are not aware as to why their name as a Trade Union was not being shown as ‘active’ since 23rd December, 2025 and it was for this reason that the petitioner could not submit the returns for the Trade Union for the period concerned. Accordingly, WPO/424/2026 stands disposed of with liberty granted to the petitioners to approach the Registrar of Trade Unions with their prayer as made in the writ application, which the Registrar of Trade Unions shall consider and decide in accordance with law, within thirty days from the date of approaching the Registrar of Trade Unions. The petitioner’s prayer for issuance of a duplicate/fresh certificate of registration shall also be decided in accordance with law. The said relief is being granted on the prayer made by the petitioners that they have lost the original certificate of registration and a General Diary (GD) to that extent has been initiated by them with the Bowbazar Police Station on 12th December, 2025, which is at page 37 of the writ application. 3 Urgent certified photostat copy of this order, if applied for, be supplied to the parties subject to compliance of all requisite formalities.
