JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused in Spl.C.No.208/2025 pending before the Court of Additional City Civil and Sessions Judge (FTSC-V), Bengaluru arising out of Crime No.921/2024 registered by H.A.L. Police Station, Bengaluru City for the offences punishable under Sections 376(3) of IPC, 1860 and Sections 5(j)(ii) and 6 of the POCSO Act, 2012, is before - 3 - HC-KAR CNR: KAHC010499242026 NC: 2026:KHC:49290 CRL.P No. 10902 of 2026 this Court in this petition filed under Section 483 of the BNSS 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.921/2024 was registered by H.A.L. Police Station, Bengaluru City for the aforesaid offences against the petitioner herein, based on the first information dated 07.12.2024 received from respondent No.2-Rita Mandol, who is the mother of the victim girl aged 15 years. During the course of investigation, the petitioner was arrested on 19.12.2024 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Mis.No.4849/2025 was rejected on 30.06.2025. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that before the trial Court, the trial is at the last stage. Learned High Court Government Pleader has brought to the notice of this Court that all the material charge sheet witnesses including the victim girl and her - 4 - HC-KAR CNR: KAHC010499242026 NC: 2026:KHC:49290 CRL.P No. 10902 of 2026 mother, have supported the case of the prosecution. He has also brought to the notice of this Court that the DNA test report would go to show that petitioner is the biological father of the aborted fetus. The petitioner hails from Assam State. Therefore, in the event he is enlarged on bail at this stage, the possibility of he fleeing away from justice cannot be ruled out. Considering the aforesaid aspects of the matter and the stage of the case, I am of the view that without expressing any opinion on the merits and demerits of the case, if the Trial Court is requested to expedite the trial and dispose of the main case within a period of three months, the same would serve the ends of justice. Accordingly, the following: ORDER The Criminal Petition is disposed of with a request to the Trial Court to expedite the trial and dispose of the main case as expeditiously as possible, but not later than a period of three months from the date of receipt of copy of - 5 - HC-KAR CNR: KAHC010499242026 NC: 2026:KHC:49290 CRL.P No. 10902 of 2026 this order, failing which the petitioner is at liberty to approach this Court afresh.
