Heard the learned counsel for the parties. 2. The present writ petition has been filed for following reliefs:- “1. That in the instant Writ Petition the petitioners pray for issuance of appropriate Writ or writs, direction or directions, order or orders to quash the entire proceeding of Demarcation Case No. 225 of 2023-24 (Annexure-3) which was filed by the Private Respondent No.4 for demarcation of the land of the Petitioners situated in Mouza Geruwala, Thana No. 107, Khata No.351 (In the Notice Khata No. 179 has been mentioned), Plot No. 2249, area 0.39 acres, District East Singhbhum; AND Petitioners further pray for issuance of appropriate Writ or Writs, direction or directions, order or orders commanding the concern Respondent i.e. Circle Officer, Patamda to pass a final order on the Representation dated 14-10-2024 of the Petitioners by which Petitioners have filed objection regarding the Notice issued vide Letter No. 663A dated 30-09-2024 for demarcation of their land.” 3. The law is settled that the Circle Officer has no power of demarcation, if there is any dispute between the parties. Neither any such provision has brought to the notice of this Court showing the Circle Officer has such power. 5. This sort of dispute can only be adjudicated and decided by the competent Civil Court. 6. In that view of the matter, the impugned notice dated 30.09.2024 issued by the Circle Officer, Patamda in Demarcation Case No.225 of 2023-24 is hereby, quashed and set-aside which is wholly without jurisdiction. 7. However, the parties are at liberty to work out their further remedies in accordance with law. 8. With the aforesaid liberty, the present writ petition stands disposed of.
