This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 245/2025 registered at Police Station - Kunkuri, District - Jashpur (C.G.) for the offences punishable under Sections 4,6,10 of the Chhattisgarh Krishak Pashu Parirakshan Adhiniyam. 2. Case of the prosecution, in brief, is that on 17.12.2025, the co- accused persons were transporting 16 cattle in a pick-up vehicle VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2026.04.02 11:04:55 +0530 2 bearing Registration No. JH-01-FK-5521, out of which one calf, one cow and one bullock were found dead. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is submitted that the applicant had no knowledge regarding the transportation of cattle in his pick-up vehicle and that the co-accused persons had taken the said vehicle on rent for transportation of vegetables. It is further submitted that the present applicant is merely the owner of the pick-up vehicle and has no direct or indirect involvement in the commission of the alleged offence. Learned counsel submits that the applicant has no previous criminal antecedents and that the essential ingredients of the alleged offences are not attracted against him. It is also submitted that the applicant is a reputed person and, if arrested, his social reputation would be seriously affected. Learned counsel further submits that the applicant is a permanent resident of the address mentioned in the cause title, possesses movable and immovable properties there, there is no likelihood of his absconding or tampering with the prosecution witnesses, and he is ready to abide by all such terms and conditions as may be imposed by this Hon’ble Court while granting bail. 4. Learned counsel for the State opposes the bail application and submits that on 17.12.2025, the present applicant found transporting 16 cattle in a pick-up vehicle bearing Registration No. JH-01-FK-5521, out of which one calf, one cow, and one bullock were found dead. Considering the seriousness of the offence, the applicant is not entitled to the grant of bail. 3 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the submissions advanced by learned counsel for the parties, the nature of the allegations and the material available in the case diary, this Court finds that in the present case, 16 cattle, including cows, calves and bulls, were being transported in pick-up vehicle bearing Registration No. JH- 01-FK-5521. Out of the said cattle, one calf, one cow and one bull were found dead. During the course of investigation, information regarding the seized vehicle was obtained and it has been revealed that the owner of the vehicle used in the commission of the offence is the present applicant/accused, looking to the gravity and seriousness of the allegations, the manner in which the cattle were being transported, and the fact that the vehicle used in the offence belongs to the applicant himself, this Court is not inclined to extend the benefit of anticipatory bail to the applicant. Accordingly, the bail application deserves to be and is hereby rejected. 7. Accordingly, the anticipatory bail application of the applicant – Sahil Khan, involved in Crime No. 245/2025 registered at Police Station - Kunkuri, District - Jashpur (C.G.) for the offences punishable under Sections 4,6,10 of the Chhattisgarh Krishak Pashu Parirakshan Adhiniyam, is rejected.
