JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 06.04.2026 Heard the learned Senior Counsel Mr. K K Mahanta assisted by Ms.M Begum appearing for the petitioner. 2. This is an application under Section 528 of the BNSS, 2023 in respect of N. I. Case No.48/2016 pending in the Court of the learned Chief Judicial Page No.# 2/2 Magistrate, Nagaon, Assam. 3. The petitioner Ranjit Saikia is an accused before the trial court. For his non- appearance, the learned trial court directed issue of Non-Bailable Warrant of Arrest against him. 4. Mr. Mahanta submits that the petitioner is interested in facing the trial and therefore, the petitioner should be given adequate opportunities to that effect. 5. I have considered the submissions made by Mr. Mahanta. 6. Since the petitioner is interested in facing the trial, therefore he deserves to be given adequate opportunities to that effect. 7. Therefore, the Criminal Petition filed by the petitioner is allowed. 8. All orders directing issue of Non-Bailable Warrant of Arrest against the petitioner in respect of N. I. Case No.48/2016 are set aside. 9. It is hereby directed that the petitioner Ranjit Saikia is directed to appear before the Court of the learned Chief Judicial Magistrate, Nagaon, Assam in respect of N. I. Case No.48/2016 within next 15 (fifteen) days from today. On his appearance, he shall be released on bail of ₹25,000/- (Rupees Twenty Five Thousand) with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Nagaon, Assam. 10. Wiith the aforesaid direction, this Criminal Petition stands disposed of accordingly. JUDGE Comparing Assistant
