Degree/ Diploma or CTS. ii. 30% weightage fixed for marks in CITS qualification to ensure that CITS passed candidates are engaged as instructors. iii. Maximum 10% weightage for interview iv. The threshold condition for experience criteria prevails as given in NOVT norms. v. The above criteria will also apply for contractual employment: 29 II. Roadmap for "Mandating CITS for all instructors. 2. For affiliation /re-affiliation for all ITIs: I. By 2018-Availability of at least 40% instructors with CITS By2020- Availability of at least 60% instructors with CITS. II. By 2022-Availability of at least 80% Instructors with CITS III. No promotion for instructors without CITS In Govt. IT'Is IV. Separate scheme for part-funding of training expenses for the training of trainers working in Private ITIs. V. At the State Government/ UT Administrations are requeted to follow above guidelines as given at Sl. No. I and II above, with immediate effect. 4. In pursuance of the said instruction issued by the Central Government the State of Chhattisgarh Skill Development Technical Education and Employment Department has amended its service rule on 15th May, 2019 namely Chhattisgarh ITIs (Non-Gazetted Recruitment Rules 2014) and provided then the candidate should be having certificate of passing (ATI/CTI/NVTI/RBTI) and for which 10 Per cent bonus marks has also been provided. 5. On the basis of these factual foundation the leaned counsel for the petitioner would submit that one of the petitioner was granted permission sponsors letter dated 25.02.2019 issued to one of the petitioner-Rashmi Verma, training officer contractor ITI, Raipur, has been cancelled by the director without any authority of law vide its memo dated 22.03.2019 (Annexure P/1) is illegality. It has also been further submitted that now the Central Government has approved the Craft Instructor Training Scheme CITS through online portal also as such there will be no difficulty for the respondent to grant permission to participate in trainings. Thus, it has been prayed for issuance of direction to the respondent/ State to issue the sponsor letters to all the petitioners. 6. The State has filed their return in which they have not disputed the initial 30 date of appointment of the petitioner on contract basis and also not disputed about the availability of online training facilities for CITC Course, but it has been clarified that the principal work not be appointing authority of the instructor on contract basis and the director of the department is the competent authority, as such cancellation of permission granted by the principal by the director is legal and justified and would pray for dismissal of this writ petition. 4. I have heard learned counsel for the parties and perused the entire record. 5. The record further reveals that no representation seeking sponsorship was ever submitted to the Director, who is the appointing authority. Therefore, in absence of any grievance having been raised before the employer, this Court could have dismissed the petition. However, considering the fact as pleaded by the petitioners in paragraph 8.2 of the writ petition that they have been working since 2007 and that more than 15 to 18 years have elapsed, the ends of justice would be served by granting the petitioners an opportunity to submit individual representations ventilating their grievances of granting permission for participating in CITS Courses before the Director and in-turn the Director shall sent the representation to the Committee to be constituted by him within 2 months from the date of receipt of copy of the order and in- turn the committee so constituted by the director shall consider and decide the representation within three months from the date of receipt of the representation made by the individual petitioners. It is made clear that no joint representation shall be submitted by the petitioners. Each petitioner shall submit an individual representation before the Committee, setting out his respective grievances. The Committee so constituted by the Director (Skill and Men Power Training and Technical Education Department) is 31 directed to examine the case of each individual petitioner, keeping in view the administrative exigencies and any possible adverse impact on the administration of the institution where they were imparting education in case of there participation in certificate courses. The Committee shall also consider the availability of online facilities for conducting the course while granting the permission to individuals. 6. With the direction the writ petition is disposed off. Sd/- (Narendra Kumar Vyas) JUDGE Arpan
