ORAL ORDER
1. Accused no.1 in Crime No.183 of 2026 registered by Pavagada Police Station, Tumakuru District for offences punishable under Sections 62, 75, 115(2), 119(1), 329(4), 351(2), 352 R/w Section 3(5) of BNS, 2023 is before this Court in this petition filed under Section 482 of BNS, 2023 seeking anticipatory bail.
2. Heard the learned counsel for the parties.
3. FIR in Crime No. 183 of 2026 was registered by Pavagada Police Station, Tumakuru District for the aforesaid offences against the petitioner based on the first information dated 02.07.2026 received from the alleged victim lady, aged 47 years. Apprehending arrest in the case, the petitioner had filed Crl.Misc.No.5265 of 2026, which was rejected on
03.08.2026. Therefore, he is before this Court.
4. In the typed first information which is submitted on 02.07.2026, it is mentioned that about 7 months prior to the

alleged incident, the petitioner had forcibly entered into the house of the victim lady and after unzipping his pant, had showed his private parts to the victim lady and tried to sexually assault her. Since he had failed in the said attempt, he allegedly had an ill will against her and on 29.06.2026, he once again caught hold of her at about 11.30 a.m, and after pulling her blouse had snatched a sum of Rs.5,000/- from her purse. When her son came there, he allegedly assaulted him and snatched away his mobile phone.

Undisputedly, in respect of the alleged incident that had taken place seven months prior to the registration of FIR in the present case, the first informant had not initiated any criminal proceedings against the petitioner. Insofar as the incident in question that had taken place on 29.06.2026 is concerned, there is a delay of three days in approaching the police.
6. Considering the nature of allegations found in the first information and also delay in approaching the police, I am of the view that the prayer made by the petitioner for grant of

anticipatory bail needs to be answered affirmatively. Accordingly, the following:-
ORDER (i) The Criminal Petition is allowed. (ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.183 of 2026 registered by Pavagada Police Station, Tumakuru District for offences punishable under Sections 62, 75, 115(2), 119(1), 329(4), 351(2), 352 R/w Section 3(5) of BNS, 2023, subject to the following conditions:
1. The petitioner shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the investigating officer/jurisdictional Court.
2. The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.

3. The petitioner shall not tamper with the prosecution witness and he shall co-operate with the Police for investigation and appear before them whenever called upon.
4. The petitioner shall not involve in similar offences in future.
