By this writ petition, the petitioners have challenged the communication dated 18.07.2025 issued by the respondent to the petitioner no.1 and also seeking direction against the respondent for not taking coercive steps against them. 2. The learned counsel for the petitioners submitted that one Vishal Jugalkishor Jaiswal entered into an agreement to sell with the petitioner no.1 on 01.03.2025 with total sale consideration of the said property being Rs.49,50,000/-. Thereafter the dispute arose regarding the sale of the said property and the suit for specific performance of contract is pending before the Civil Judge (Senior Division) Achalpur, District Amravati. The petitioners have also preferred the anticipatory bail applications before the Sessions Judge, Achalpur. Now, the respondent has issued a communication dated 18.07.2025 asking the petitioner no.1 to appear before him. It is submitted that on three earlier occasions the petitioner no.1 has appeared before the Investigating Agency, however, the Investigating Officer/concerned Police Officer is repeatedly calling him only for harassment. 2026:BHC-NAG:11098-DB 2 CRIWP601-26.odt 3. The learned Additional Public Prosecutor strongly opposed the said contention and submitted that for enquiry purpose, the said communication has been issued to the petitioner no.1 and there is no illegality in issuing the same. 4. Considering the allegations levelled by the petitioner, it is apparent that the criminal complaint was filed against the petitioners in respect of the transaction taken place between Vishal Jugalkishor Jaiswal and the petitioner no.1. It is the contention of the petitioners that the petitioner no.1 has served a legal notice through his lawyer to the respondent, however there is no reply received to the said notice. 5. In view of above, it would be necessary to direct the petitioner no.1 to appear on 01.09.2026 before Senior Police Inspector, Paratwada and file his submissions in writing alongwith all annexures. The respondent shall accept the said document and take appropriate steps. If the petitioners are again called by way of harassment, they are granted liberty to file appropriate proceedings. 6.
