[1] When the matter was taken up, it came to light that all appropriate parties have not been arrayed as respondents. [2] Faced with the above situation, Mr. Md. Fakharuddin, learned counsel on record for writ petitioner sought leave of this Court to withdraw captioned Writ Petition (WP) and he made a further plea to preserve all the rights and contentions of writ petitioner and/or any other person/s concerned for the detenue to file another WP assailing the same impugned order with same prayer i.e., on the same issue.
