Impugned in this petition, filed by the Union of India under Article 226 of the Constitution of India, is an order and judgment dated 16.09.2025 passed by the Armed Forces Tribunal, Regional Bench Srinagar at Jammu [“the Tribunal”] in OA No. 206/2023 titled “Ex Hav Karnail Singh Vs. Union of India and others”, whereby the Tribunal has held the respondent entitled to grant of disability element for disability in respect of “Primary Hypertension” @ 30 % rounded off to 50 % w.e.f 01.11.2022 for life. 2. The issue raised in this petition is no longer res integra and is fully covered by our judgment titled “Union of India Vs. Nirman Singh Sr. No. 04 2 WP(C) No. 302/2026 Jamwal”, bearing WP(C) No. 3173/2023 and clubbed matters, which was decided by this Court on 13.11.2025. 3.
