The instant criminal writ petition has been preferred by the petitioners Ankit Singh Rawat and Smt. Pooja Chamoli praying for quashing of the First Information Report dated 13.02.2025 bearing FIR No. 0059 of 2025 P.S. Kotwali Dehradun, District Dehradun, wherein, the petitioners have been implicated for the offence punishable under sections 318(4) and 351(3) of BNS, 2023. 5. The writ petition is supported with the compounding application along with the affidavits of the petitioners as well as respondent no. 3. The petitioners are present in court and are identified by their respective counsel through their Aadhar cards. The respondent no. 3/complainant is also joined proceeding through V.C. and his affidavit is also on record and is identified by his counsel. 6. The dispute arising out of two cheques which got dishonoured and the respondent no. 3 filed a complaint under section 138 of N.I. Act and then the matter was referred to the Lok Adalat wherein the matter was settled entire amount have been paid to the complainant, which is evident from the order passed by the National Lok Adalat dated 13.12.2025. 7. Learned counsel for the parties submits that though the complainant filed the complaint under section 138 of N.I. Act but simultaneously he also lodged the impugned FIR. Now, in the compounding application it is contended that infact entire amount has been given to the respondent/complainant, which is evident from the order passed by the Lok Adalat and as such the FIR be quashed. 8. This court interact with the complainant also, who also submits that he has received the entire money and he does not want to pursue the impugned FIR. 9. The State counsel also fairly submits that both the penal provisions are compoundable. 10. In such view of the matter, the writ petition as well as the compounding application are allowed and the impugned FIR dated 13.02.2025 bearing FIR No. 0059 of 2025 P.S.
