ORAL ORDER
Heard learned counsel for the petitioners and also learned counsel for the respondents. Both the learned counsel submit that the evidence has already commenced and the complainant has also been examined. Learned counsel appearing for the respondents would submit that the matter is already set down for arguments, whereas learned counsel for the petitioners would submit that PW.1 is yet to be cross-examined.
2. Having considered the said submission, when the trial has already commenced and the witness is also examined, the question of entertaining this petition does not arise. This petition arises out of an application filed for discharge and the same has been rejected, which order has been confirmed by the Revisional Court. When the trial has already commenced, the question of considering the application for discharge does not arise and hence, in view of the evidence having already commenced, no ground is made out to consider the application

filed under Section 239 of Cr.P.C. Accordingly, I pass the following:
ORDER i. The petition is disposed of. ii. The learned Trial Judge is directed to dispose of the matter within a period of six months from today.
