2 aged about 14 years was subjected to sexual harassment by their neighbor i.e. present applicant herein. It is further alleged that the applicant being neighbor of the victim used to visit her house frequently. It is also stated that in the last Navratri, when victim was alone in her house, the applicant entered from back door and attempted to outrage her modesty and also touched her private part, but due to fear the victim did not disclose said incident to her mother. Subsequently, on 10.08.2024 at about 06:30 pm, the applicant again came to the house of the victim and tried to outrage her modesty, thereafter the victim disclosed the incident to her mother on 12.08.2024 and consequently F.I.R. was lodged. 3. Learned Senior Advocate appearing for the applicant would submit that the applicant is innocent and he has falsely been implicated in the case due to previous enmity between the families of the complainant and the applicant.
Learned Senior Advocate would contend that on 02.09.2024, the mother of the applicant had made a written complaint before the Superintendent of Police, Durg against father of the victim and in retaliation, the complainant party lodged a false complaint. It is also argued that charge-sheet has already been filed and the applicant is in jail from 30.06.2026, therefore, this bail application may be allowed. 4. On the other hand, learned Panel Lawyer appearing for the State would oppose the bail application. 5. I have heard learned counsel for the parties and perused the case diary. 6. Victim along with her mother appeared through video conferencing from DLSA, Durg and she has raised serious objection in grant of bail to the applicant. 3
7. Having considered the facts and circumstances of the case, particularly the fact that F.I.R. was lodged against the applicant on 04.09.2024 and he remained absconding for period of 02 years and was arrested on 30.06.2026; age of the victim at the time of incident was 14 years; the victim in her statement recorded under Section 183 of BNSS has made serious allegation of molestation and further taking note of material collected by the prosecution during course of investigation, I am not inclined to release the applicant on regular bail. Accordingly, the bail application is rejected. Sd/-
