2. Mr. N.S. Pundir, Deputy Advocate General for the State of Uttarakhand.
3. Petitioners were appointed as Forest Guard in the year 2005 and presently they are serving as Forester. According to them, there are sufficient number of vacancies available on the next promotional post of Deputy Ranger, but, no promotion exercise has been initiated.
4. The reliefs sought in the writ petition are as follows: -
“I. Issue a writ, order or direction in the nature of Mandamus to the Respondents authorities to initiate prom otion process from post of Forester to post of Deputy Ranger in accordance to the provisions of Rule-5 (1) and 16 of Uttarakhand Subordinate Forest Service Rule-2016;
II. Issue a writ, order or direction in the nature of Mandamus to the Respondents to authorities to grant prom otion to the Petitioners according to Governm ent
order dated 25.06.2025 (Annexure-07) and 08.10.2025 (Annexure 08) as well as the interim order dated 21.05.2025 (Annexure-06) passed by the Hon'ble Public Service Tribunal Uttarakhand Dehradun in Claim Petition No. 28/ NB/ DB/ 2022 Mahesh Chandra Joshi and others Vs. State of Uttarakhand and others;
III. Issue a writ, order or direction in the nature of Mandamus to the Respondents Authorities to consider the representation dated 16.12.2025 (Annexure- 11) of Petitioners regarding their prom otion from the post of Forester to Deputy Ranger as per the law and circum stances m entioned in it.”
5. After arguing for a while, learned counsel for the petitioners submits that petitioners be permitted to make

6. Learned State Counsel submits that he has no objection if the writ petition is
disposed of in terms of the prayer made by learned counsel for the petitioners.
7. The writ petition is, accordingly,
disposed of with liberty to petitioners to make representation to the competent authority. If they make representation within two weeks from today, decision thereupon shall be taken, as per law, within four months thereafter.
