THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE JAYANT BANERJI & HON'BLE MS. JUSTICE TARA VITASTA GANJU ORAL ORDER (PER: HON'BLE MR. JUSTICE JAYANT BANERJI) A compliance affidavit sworn by Shri Shivaswamy B, presently officiating as Executive Director, Karnataka Residential Educational Institutions Society, is on record. Paragraph Nos.5, 6 and 7 of the affidavit reads as follows: “5. I state that, immediately after passing of the aforesaid interim order dated 19.07.2023, the learned counsel appearing for the Respondent No.4 (Society) - 3 - HC-KAR CNR: KAHC010527562025 NC: 2026:KHC:48916-DB CCC No. 1019 of 2025 intimated the interim order to the respondent No.4 (Society). Upon perusal of the interim order and after considering the relevant records, the respondents have fully complied with the direction issued by this Hon’ble Court. The complainant has not been disturbed from his post and has continued to discharge his duties as outsource principal in the said school. 6. I further state that though the respondent No.1, Principal Secretary, Department of Social Welfare, has issued a general transfer order dated 30.06.2025 whereby the permanent Principal was transferred to the post of Principal at Morarji Desai Residential School (105), Mullegudda, Nanjangud Taluk, Mysore District, the said transfer order has not been acted upon in a manner contrary to the interim order dated 19.07.2023. In view of the specific direction issued by this Hon’ble Court, both the complainant and permanent Principal were permitted to continue to discharge their respective duties, subject to the outcome of the pending writ petition. Accordingly, the complainant has continued to work as outsource principal and has not disturbed from his service. Hence, there has been no wilful or deliberate disobedience of interim order passed by this Hon’ble Court. 7. I most respectfully submit that the Complainant has been continuously working from the date of the interim order till date. In support of the same, the relevant extracts of the Attendance Register for the months from June 2025 to August 2026. I further state that the complainant is engaged through an outsourcing agency and his remuneration has been paid through the said agency. The copies of the Attendance Register and Salary slips are herewith produced and marked as Annexure-R1 series.” 2. The affidavit also contains an unconditional apology proffered by the accused.
