Since no adverse order is passed against the private respondent, notice to the private respondent is dispensed with. 2. This writ petition has been filed challenging the order of the sixth respondent granting permission to the 12th respondent to lay a pipeline across https://www.mhc.tn.gov.in/judis WP No. 23771 of 2026 public land from palladam village (S.No.186/6) to chakkarapaniyam village (S.No.46/4), quash the same and consequently direct the respondents 1 to 11 to consider and pass appropriate orders on the petitioner's representation dated 12.06.2026 3. It is the case of the petitioner that the petitioner owns 6 acres of agricultural land in Ammapalayam Panchayat, Palladam Taluk, Tiruppur District, whose livelihood depends upon agriculture sustained by the village water tank. However, the 12th respondent instead of utilizing water for genuine agricultural purposes, diverted it through pipelines and lorries for commercial exploitation, including supply to a stone quarry and for water sales, thereby depriving the petitioner and villagers of irrigation and drinking water. In this regard, the petitioner has filed a writ petition before this Court in WP.Crl.No.587 of 2025 seeking police protection for laying the pipeline and obtained an order for police protection for laying the pipeline underground. It is the grievance of the petitioner that the pipeline permission was granted strictly for irrigation purposes, but the same has been misused for commercial gain in violation of statutory conditions. Hence, this petition has been filed seeking to cancel the permission granted to the 12th respondent for laying pipeline. 4. The learned counsel for the petitioner submitted that if at all the petitioner is permitted to lay pipeline across public land from Palladam Village https://www.mhc.tn.gov.in/judis WP No. 23771 of 2026 to Chakkarapaniyam Village, the water source will get depleted which the 12th respondent is utilising for commercial purpose. If the water get depleted, the villagers will be greatly put to hardship who are dependent on the ground water for their agricultural activities. Hence, seeks for allowing this writ petition. 5. The learned Government Counsel submitted that only after detailed enquiry on 16.05.2025, the 6th respondent has granted permission to lay pipeline from the 12th respondent agricultural land, that apart, this Court vide order dated 24.09.2025 in WP.Crl.No.587 of 2025 has also granted police protection to lay pipeline from the 12th respondent's agricultural land. Further, it is also stated that the pipeline is not allowed by the official respondents to be laid in the Government land. Hence, prays for dismissal of this writ petition. 6. Heard both sides and perused the materials placed on record. 7. On perusal of the case file, it would indicate that the 12th respondent has originally obtained permission from the 6th respondent for laying pipeline from his agricultural land and subsequently, the 12th respondent has also filed a writ petition in WP.Crl.No.587 of 2025 seeking police protection for laying pipeline from his agricultural land. This Court by order dated 24.09.2025 has granted police protection to the 12th respondent herein on the ground that the petitioner is carrying on such work only after getting necessary permission. In https://www.mhc.tn.gov.in/judis WP No. 23771 of 2026 such view of the matter, when this Court has impliedly affirmed the permission granted to the 12th respondent, the petitioner, if at all, aggrieved, ought to have challenged the order dated 24.09.2025. Instead of challenging the order, challenging the permission granted by the 6th respondent is not sustainable one. That apart, it is also brought to the notice of this Court that the 12th respondent is not permitted to lay or erect any pipeline in the Government land. 8. In view thereof, this Court does not find any merits in the writ petition and this writ petition stands dismissed. No costs.
