This is an application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of PRC Case No.1084/2020, pending in the Court of the learned Additional Chief Judicial Magistrate, Sonitpur, Tezpur. Page No.# 2/2 3. The petitioner, Sunil Gayari @ Shunil Gayari is an accused before the Court below. He did not appear on fixed dates and, therefore, Trial Court directed issue of NBWA directed issue against him. 4. I have considered the submissions made by the learned counsel for both sides. 5. All orders directing issue of NBWA against the present petitioner, Sunil Gayari @ Shunil Gayari, by the learned Additional Chief Judicial Magistrate, Sonitpur, Tezpur are set aside. 6. The petitioner, Sunil Gayari @ Shunil Gayari is directed to appear before the Additional Chief Judicial Magistrate, Sonitpur, Tezpur in respect of PRC Case No.1084/2020 within 19.05.2026 and on his appearance, the petitioner shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the Additional Chief Judicial Magistrate, Sonitpur, Tezpur. 7.
