1. Heard Mr. R. Baruah, learned counsel for the petitioner. Also heard Mr. D. P. Goswami, learned Additional Public Prosecutor for the State of Assam.
2. This is an application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of PRC Case No.1084/2020, pending in the Court of the learned Additional Chief Judicial Magistrate, Sonitpur, Tezpur.

3. The petitioner, Sunil Gayari @ Shunil Gayari is an accused before the Court below. He did not appear on fixed dates and, therefore, Trial Court directed issue of NBWA directed issue against him.
4. I have considered the submissions made by the learned counsel for both sides.
5. All orders directing issue of NBWA against the present petitioner, Sunil Gayari @ Shunil Gayari, by the learned Additional Chief Judicial Magistrate, Sonitpur, Tezpur are set aside.
6. The petitioner, Sunil Gayari @ Shunil Gayari is directed to appear before the Additional Chief Judicial Magistrate, Sonitpur, Tezpur in respect of PRC Case No.1084/2020 within 19.05.2026 and on his appearance, the petitioner shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the Additional Chief Judicial Magistrate, Sonitpur, Tezpur.
7. With the aforesaid direction, this Criminal Petition stands disposed of. JUDGE Comparing Assistant
