AAAG Ms. Mrinmayee Das …….for the Siliguri Municipal Corporation The grievance of the petitioner is directed against illegal and unauthorized use and occupation of the premises by the private respondents. It is submitted on behalf of the petitioner that the private respondents have been carrying on a Nursing Home from the premises situated at Bidhan Road, Siliguri which is a congested market area. This is a second round of litigation between the parties. By an earlier order dated 20.05.2025, the Corporation had directed the private respondents to immediately stop any unauthorized use of 2 the second floor of the building as a Nursing Home. On behalf of the private respondents, it is submitted that in terms of the order dated 20.05.2025, the Nursing Home has stopped and there is no illegal nor unauthorized use of the second floor of the said building. On behalf of the Corporation, it is submitted that in view of the grievance of the petitioner, they will revisit the entire issue and consider the matter afresh. In such circumstances, WPA 1530 of 2025 stands disposed of by directing the Commissioner, Siliguri Municipal Corporation being the respondent no. 2, to address the complaint of the petitioner afresh and pass an order with a period of twelve weeks from the date of communication of this order. Liberty is granted to the Commissioner, Siliguri Municipal Corporation to hear the parties, if found necessary. With the above directions, WPA 1530 of 2025 stands disposed of. (RAVI KRISHAN KAPUR, J.)
