ORAL ORDER
1. Accused no.1 is before this Court in this petition filed under Section 482 of Cr.PC with a prayer to quash the entire proceedings in CC.No.2862/2023 pending before the Court of VII Addl. Civil Judge & JMFC, Hassan, arising out of Crime No.29/2023 registered by Hassan Women Police Station, Hassan, for the offences punishable under Sections 498A, 323, 504, 307 IPC and Sections 3 & 4 of Dowry Prohibition Act,
1961.
2. Heard the learned Counsel for the parties.

Learned Counsel for the petitioner and the learned Counsel for respondent no.2 jointly submit that the dispute between the parties who are husband and wife has been amicably settled and reported before the Court of I Addl. Prl. Judge, Family Court, Hassan, in Crl. Misc. No.63/2025. - 3 -

4. In the compromise petition that was filed before the Family Court, the parties have undertaken to withdraw the present criminal case. In terms of the settlement arrived between the parties which was reported before the Family Court, a Demand Draft of Rs.1,20,000/- is paid by the petitioner to respondent no.2 and the receipt of the same is duly acknowledged by respondent no.2 who is present in person before the Court. 5. The parties who are present before the Court in person are identified by their respective learned Advocates. The joint affidavit filed by petitioner and respondent no.2 along with documents is taken on record. In paragraph 1 to 4 of the joint affidavit, it is stated as under:
"1. It is submitted that both the petitioner and the respondent No.2 have settled the dispute amicably before the Hon'ble 1st Addl. Prl. Judge Family Court, Hassan in Crl.Misc.No.63/2025 as per the terms of mediation agreement entered between the parties dated:29-08-2026 kindly read the same as part and parcel of this affidavit along with joint mediation agreement which is annexed along with this joint affidavit. - 4 -

It is further submitted that the petitioner/Accused and the Respondent No.2 were the husband and wife and both of them have decided to withdraw the allegations against each other as per the terms of the joint mediation agreement and they have decided to settle the above criminal case since the Respondent No.2 do not wish to continue the litigation. 3. It is further submitted that in view of the settlement/as per the terms of compromise, between the parties respondent No.2 agreed to withdraw the case filed in Crl.Misc.No.6/2024 and 431/2026 are pending on the file of VI Addl.Civil Judge and JMFC, Hassan and also agreed to give consent to quash the Proceedings in C.C.No.2862/2023 for the offences punishable under Section 498A,323,504,307 of IPC and S.3,4 of The Dowry Prohibition Act, 1961 pending on the file of The VII Addl.Civil Judge & JMFC, Hassan.
4. It is further submitted that both petitioner and Respondent No.2 have settled the above case without any influence or coercion etc., and after careful reading of this joint memo/affidavit have affixed their signature with free consent."

6. The Hon'ble Supreme Court in the case of RAMGOPAL AND ANOTHER Vs. STATE OF MADHYA PRADESH -2021 SCC ONLINE SC 834, has held that notwithstanding the limitations provided under Section 320 of Cr.P.C,, this Court can exercise its powers under Section 482 of Cr.P.C, and can quash criminal proceedings, registered even for non-compoundable offences depending upon the gravity, nature of the offence and also the nature of settlement arrived between the parties. 7. In the present case, the dispute is between the family members and the same is now settled inter se and the parties have decided to give a quietus to the dispute inter se between them. Under the circumstances, I am of the opinion that, this is a fit case wherein this Court is required to exercise its jurisdiction under Section 482 of Cr.PC, in order to secure the ends of justice. Accordingly, the following order:
8. Criminal petition is allowed. The entire proceedings in CC.No.2862/2023 pending before the Court of VII Addl. Civil Judge & JMFC, Hassan, arising out of Crime No.29/2023 registered by Hassan Women Police Station, Hassan, for the offences punishable under Sections 498A, 323, 504, 307 IPC
