Mr. Vinod Chandra, learned counsel for the petitioner. 2. Mr. Lalit Samant, learned counsel for the respondents-Uttarakhand Transport Corporation. 3. Petitioner was employed with Uttarakhand Transport Corporation and he retired as In-charge Driver-Instructor on 31.07.2025. On the date of retirement, an order of recovery was also passed against him by the Assistant General Manager (Rural), Uttarakhand Transport Corporation, Dehradun. 4. Perusal of said order reveals that a sum of ₹14,84,134/- was payable to petitioner as Gratuity, out of which, a sum of ₹5,56,865/ - was directed to be recovered. 5. Petitioner contends that he was not liable for any recovery; the recovery order was passed without any notice or opportunity of hearing and the recovery is bad in the view of Division Bench judgment dated 05.06.2024 rendered in SPA No. 245 of 2022 & other connected matters. 6. Mr. Lalit Samant, learned counsel appearing for Uttarakhand Transport Corporation, however, submits that petitioner has made representation to Regional Manager, Uttarakhand Transport Corporation, Dehradun on 07.02.2026, 2026:UHC:1213 therefore, he may be directed to take decision on the said representation. 7. The writ petition is, accordingly, disposed of by directing the Regional Manager, Uttarakhand Transport Corporation, Dehradun to take decision on petitioner’s representation dated 07.02.2026, as per law, within six weeks from the date of presentation of certified copy of this order. It goes without saying that the Division Bench judgment rendered in SPA No. 245 of 2022 shall be borne in mind by Regional Manager while taking decision.
