Nawaz, learned counsel for the petitioners also heard Mr. P. Borthakur, learned Addl. P.P appearing for the State. The accused/petitioners, namely Abdul Khalil @ Md. Khalilur Rahman, Jamaluddin, Habidur Rahman and Jiabur Rahman are invoking the powers under section 483 of BNSS, 2023 praying for the grant of regular bail in connection with Tezpur P.S Case No. 768/2025 u/s 118(2)/127(2)/3(5) of BNS, 2023. The case arose out of an FIR lodged by one Abdul Aziz Khan alleging that on 04.12.2025 9 accused persons therein that on 03.12.2025, in the night around 8:00 p.m, while he was going to a shop, the accused persons named in the FIR confined his nephew Rijuwan Ahmed, tied him with a rope and assaulted him in his body parts and later, when he along with his other son proceeded to the spot, they were also assaulted. The Case Diary called for has been received. In the statement, the alleged victim Rijuwan Ahmed has supported the allegation. The medical reports are available of three alleged victims including Rijuwan Ahmed and all of them indicated simple injuries with blunt object. The accused/petitioners were are in custody since 20.02.2026 after their arrest. I have seen the progress of the investigation. Considering the length of detention, the progress of investigation and the Page No.# 3/3 fact that though the victim has supported about the assault, but the injuries are medically labeled as simple--I deem it proper to grant bail at this stage. In such view of the matter, the accused/petitioners mentioned herein above shall be allowed to go on bail on furnishing a bail bond of Rs. 25,000/- each with one suitable surety of the like amount subject to the satisfaction of learned CJM Tezpur, subject to the conditions that; they shall co-operate with the remaining investigation; they shall not hamper or tamper with evidence; they shall not misuse the liberty to commit any illegal activity or offences and they shall not harm the informant side in any manner.
