THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY WRIT PETITION NO: 10694/2026 The Court made the following Order: This Writ Petition is filed seeking the following relief:
“…to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the Respondents not releasing the amount of Rs.4,07,700/- vide M Book No.870/B/20, even after finalizing the bills, payable to the petitioner in relation to the works i.e., Transportation of drinking water with tanker I.D.No.AP27CA3116 in Muraripalli Village of Y.Palem Mandal, vide Sub-Divisional Agreement No. /2023-24, dated 16.12.2023 is questioned, as the same is illegal, arbitrary and consequently direct the respondents to pay for payment of amount of Rs.4,07,700/- vide M Book No. 870/B/20 to the petitioner in respect of execution of above-mentioned work forthwith and pass such other or further orders…”
2. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Panchayat Raj and Rural Development. 3. The petitioner was awarded the work of transportation of drinking water through tanker vide Tanker ID No.AP27CA3116 in Muraripalli Village, Y.Palem Mandal, Prakasam District under the proceedings dated 12.12.2023 issued by the respondent No.7 and consequential work order dated 16.12.2023 issued by the respondent No.6. The petitioner entered into an agreement with the authorities and duly executed the entrusted work within the stipulated time by utilizing his own funds. Upon completion of the work, respondent authorities verified the work, recorded the same in M.Book No.870/B/20, prepared and finalized bills and passed memo of payment on 18.12.2023. An amount of Rs.4,07,700/- became payable to the petitioner towards the said work. SRK,J W.P No.10694 of 2026 4
However, the respondents, despite completion of work and having admitted and processed the bill, failed to release the payment. The petitioner repeatedly approached the authorities seeking release of the admitted bill amount, but no payment is made. The inaction of the respondents has caused severe financial hardship to the petitioner as he had borrowed money to execute the work. Hence the Writ Petition. 4. It is the grievance of the petitioner that notwithstanding the completion of the work and its measurement by the competent authorities, the amount due towards the executed work has not been paid till date.
According to the petitioner, although the work was completed more than three years ago, the respondent authorities have not released the admitted amount payable to him. Aggrieved by the non-payment of the said amount, the petitioner filed the present Writ Petition. 5. Learned Assistant Government Pleader, on written instructions, from the Executive Engineer, RWS (P), Division, Podili-6th respondent, submits that there is no dispute with regard to the execution of the work by the petitioner. According to him, the petitioner is entitled to an amount of Rs.3,79,160/- after statutory deductions such as QC recovery/withheld amount, aggregating to Rs.28,540/-, and that bill has to be paid to the petitioner, after release of budget from the Government, and seeks six months’ time for payment of the said amount. Having regard to the fact that there is no dispute with regard to the work executed by the petitioner and the amount payable to him, and in view of the submissions of the learned Assistant Government Pleader, the respondent authorities are directed to pay a sum of Rs.3,79,160/- (Rupees three lakhs seventy nine thousand one hundred and sixty only) to the petitioner within a period of four (04) weeks from the date of receipt of a copy of this order. 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
