Let affidavit-of-service, as filed in Court, be kept on record. 2. The petitioner is aggrieved that his service as a Night Guard has not been regularized even though he has served in such post since 2010. 3. The petitioner was initially employed as a Cleaner on daily wage basis by the Excise Department of the Government of West Bengal, sometime in January, 1989. 4. He has been assigned duties of the Night Guard since 2010, as there was a vacancy in that post. He is still carrying on as a Night Guard. 5. Petitioner prays for pay as a Night Guard which is classified as a Group-D staff in terms of the appropriate Pay Band of ROPA 2009. 2 6. The petitioner has also made a representation for such purpose on 22nd July, 2026. The representation has not been considered as on date. 7. I direct the respondent no. 2 to make the appropriate investigations and consider the representation within a period of twelve weeks from date. 8. Resultant order will be communicated to the petitioner within a period of two weeks thereafter. 9. With the aforestated directions, the writ petition is disposed of. 10. There will be no order as to costs. 11. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon usual undertakings. (Reetobroto Kumar Mitra, J.)
