1. One Mr. Bhupal @ Bhopal Raut, son of late Sona Raut, resident of Village Bharkunda is the sole appellant who has been convicted under Section 307 of I.P.C. and Section 4 of Explosive Substance Act vide judgment dated 29.03.2017 and sentenced to undergo rigorous imprisonment for 5 years and to pay a fine of Rs. 5,000/- (rupees five thousand) under Section 307 of Indian Penal Code and awarded additional one month simple imprisonment in case of default of payment of fine and under Section 4 of Explosive Substance Act sentenced to undergo rigorous imprisonment for 5 years and fine of Rs. 5,000/- (rupees five thousand) and in default of payment of fine, awarded additional one month simple imprisonment and all sentences were directed to run concurrently vide order of sentence dated 31.03.2017 by the learned District & Additional Sessions Judge-IV, Dumka.
2. A report submitted by the Officer-In-Charge, Saraiyahat, Police Station, Dumka, which is available on record, reveals that the sole appellant, namely, Bhupal @ Bhopal Raut son of late Sona Raut has died on 04.02.2023. The said report is also annexed with a copy of the death certificate of the appellant.
3. On last date of hearing, i.e., on 12th January, 2026, no one appeared for the appellant.

4. Today also, when the matter has been taken up, no one is present on behalf of the appellant.
5. Mrs. Priya Shreshtha, learned Spl.P.P. for the State is present through virtual mode.
6. Considering the aforesaid facts and circumstances, this appeal being, Criminal Appeal (S.J.) No. 704 of 2017 is dismissed as abated.
