This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Junior Division), Barasat, North 24 Parganas, to dispose of the injunction application filed in Title Suit No. 560 of 2018, expeditiously. The learned advocate appearing for the petitioner submits that 16th February, 2027 is fixed for hearing of the application for temporary injunction. From the order sheet appended to this application, this Court finds that 16th February, 2027 is fixed for hearing of the application for temporary injunction and for service of copy of the amended plaint and injunction application. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioner, this civil revisional application stands disposed of by requesting the learned Civil Judge (Junior Division) Barasat, to take up the hearing of the application under Order 39 Rule 1 and 2 of the Code of Civil Procedure on the next date fixed i.e. 16th February, 2027, if the same otherwise ready for hearing and make an endeavour
2 to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. The learned trial court is requested to make an endeavour to dispose of the interlocutory application as expeditiously as possible keeping in mind that the suit is pending from the year 2018. The learned trial judge is requested to dispose of the suit expeditiously. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
